Who this guide is for
Foreign nationals planning or performing paid work in mainland China and the employers sponsoring them. Permanent residents may work using their Foreign Permanent Resident ID Card under Exit and Entry Administration Law Article 48. Diplomats, journalists, offshore petroleum personnel, performers, short-term workers and other special categories may follow different documents and should use their competent authority’s route.
The documents are not interchangeable
| Document | Main purpose | Typical issuer / user |
|---|---|---|
| Notification Letter of Foreigner’s Work Permit 外国人工作许可通知 | Pre-entry approval used for the work-visa stage; it is not the physical work permit. | Employer applies through the foreigner work-management system; applicant uses it for the visa. |
| Z Visa Z字签证 | Entry visa for work. For most long-term cases it is the bridge to post-entry permits, not the continuing authorization document. | Chinese embassy/consulate or other authorized visa authority. |
| Foreigner’s Work Permit 外国人工作许可证 | Authorizes the approved employment, employer, position and location/scope recorded by the work authority. | Local administration of foreigners working in China; employer normally submits. |
| Work-Type Residence Permit 工作类居留许可 | Authorizes residence for work and permits entry/exit during validity. | Local public-security exit-entry administration; applicant normally attends. |
Exit and Entry Administration Law Article 41 requires foreigners working in China to obtain a work permit and work-type residence permit. Article 43 treats work outside the scope of a work permit, work without both required authorizations, and certain unauthorized student work as unlawful employment.
A typical long-term employment timeline
- Employer pre-check. Confirm that the China entity can sponsor the actual role and location, and that the applicant fits the applicable category and local criteria.
- Collect and authenticate documents. Common items include passport, photo, qualification/degree evidence, relevant work-experience evidence, no-criminal-record evidence, health documentation, and a Chinese employment contract or appointment document. Exact form, authentication and translation rules vary.
- Employer applies for the Notification Letter. Keep the application number and approved role, employer, salary, work location and validity consistent with the contract.
- Employee applies for the appropriate visa. Usually Z for ordinary employment. Follow the issuing mission’s current list.
- Enter China and register accommodation. Hotel registration is handled by the hotel; non-hotel accommodation is generally registered within 24 hours under Article 39. Current online options vary by place.
- Complete the Foreigner’s Work Permit process. The current local service guide controls the deadline and original-document check. Do not confuse the Notification Letter with completion of this step.
- Apply for the work-type residence permit. Z-visa holders generally must apply within 30 days of entry, except the short-work exception stated on the visa. Submit the work permit and locally required documents.
- Verify the issued records. Check name, passport, employer, purpose, location and expiry dates immediately; calendar renewals and passport validity.
This is a common sequence, not a universal one. Some people can apply or change status in China under specific rules and local acceptance; R-visa, permanent-residence and special-industry cases differ.
Who does what
| Employer responsibility | Employee responsibility |
|---|---|
| Use a qualified, registered entity and accurate role/location. | Provide genuine, consistent documents and disclose relevant changes. |
| Submit and track work-permit applications; provide stamped documents. | Attend appointments, biometrics or interviews when required. |
| Keep the contract and permit application aligned. | Do not work outside the approved scope or before authorization. |
| Apply for renewal early; the official 2025 guide says 30 days before work-permit expiry. | Monitor passport and residence expiry and cooperate promptly. |
| Report/handle termination and work-permit cancellation or change. | Coordinate the residence-permit change, stay or exit with public security. |
Ask for proof of filing and the final permit record. A recruiter saying “it is in process” is not enough to establish that you may work.
Short-term work of 90 days or less
The 2014 short-term work procedure covers listed tasks completed in no more than 90 days and also lists activities that are not treated as those short-term work tasks. Covered workers generally obtain the designated work approval/proof and a Z visa. If the approved work is no more than 30 days, the Z visa can contain the work-period annotation and no residence permit is obtained. If the approved short-term work exceeds 30 days, the procedure calls for a work-type residence permit with a stay up to 90 days.
Do not infer that every business trip under 90 days is “short-term work,” or that every technical visit requires the same route. The activity—not only length and payment location—matters. The official procedure specifically distinguishes certain installation, bid-project supervision, branch assignment, competition and volunteer activities. Give the local authority a concrete task description before travel.
M, L, S and other statuses
M (business), L (tourism), S (private affairs) and visa-free entry authorize their stated visit purposes; they are not general work authorization. A spouse or family member’s residence status also does not automatically confer the right to work. An employer’s promise to “convert it later” does not protect work already performed without authorization.
Permanent residents are an important boundary: Article 48 allows a foreign permanent resident to reside and work in China with the permanent-residence document. Even then, the employment contract, tax and social-insurance analysis remains. Students need the specific approval and notation required for qualifying part-time work or internships; do not rely on verbal approval from a university or company.
Changes, renewal and leaving a job
- Personal information or position: the 2025 official guide says changes such as name, passport number and position should be filed with the work authority within 10 working days.
- Residence record: Exit and Entry Administration Law Article 33 requires registered-item changes to be filed with exit-entry administration within 10 days.
- Employer, profession or city: do not start under the new arrangement merely because the old documents remain valid. The foreign-employment rules tie the employer to the permit and distinguish changes from new applications.
- Renewal: the official guide says the employer should apply 30 days before work-permit expiry; Article 32 separately uses 30 days before residence-permit expiry.
- Termination: the employer must promptly handle reporting/cancellation duties. Employment ending does not automatically resolve residence status; obtain the cancellation or change documents and ask public security what status applies during the transition.
Document checklist and ways to verify status
- ✓ Passport valid for the local required period and blank pages
- ✓ Recent compliant photo
- ✓ Signed Chinese contract/appointment with employer, role, location, salary and dates
- ✓ Degree/qualification and work-experience evidence
- ✓ No-criminal-record and health evidence in required form
- ✓ Required authentication/apostille and Chinese translation
- ✓ Notification Letter and application number
- ✓ Correct visa annotation and entry date
- ✓ Accommodation registration
- ✓ Work Permit record/card details
- ✓ Residence Permit details and expiry
- ✓ Copies stored outside employer systems
Ask the employer for the application status visible in the official system. For immigration questions, use the National Immigration Administration’s 12367 service or the local exit-entry bureau; for work-permit questions, contact the local foreigners-working authority. If an employer delays, document each request, do not begin unauthorized work, and get independent advice rather than surrendering your passport for an open-ended period.
Hypothetical situations
Hypothetical 1 — business visa: an Australian consultant enters on M status for meetings, then the client asks her to manage staff for two months. Before accepting, the parties must have the authority classify the actual activity; calling salary an overseas “consulting fee” does not decide authorization.
Hypothetical 2 — delayed residence permit: a Z-visa holder arrives but HR schedules the residence process after day 30. The employee should escalate immediately and contact local exit-entry administration; a pending internal ticket does not extend the legal deadline.
Hypothetical 3 — new employer: a foreign engineer resigns in Hangzhou and signs in Shanghai. The old permit’s validity does not authorize work for the new sponsor. Both sides should map cancellation, new approval and lawful residence before setting the start date.
This guide has High regulatory risk because local procedures and document acceptance change. Confirm the current path with both competent authorities before travel, work or an employer change.
