Who this guide is for
Foreign employees paid for work in mainland China, including local hires, assignments and split payroll. The guide explains records and questions; it does not calculate an individual’s tax. Cross-border workdays, equity, bonuses, tax equalization, treaty claims and multiple employers require professional tax advice.
Read the payslip from gross to net
| Line | What it means | What to check |
|---|---|---|
| Gross fixed pay | Contract salary before employee deductions. | Matches the signed schedule and any mid-month proration. |
| Variable pay | Bonus, commission or overtime earned under its rules. | Measurement, approval and payment period. |
| Benefits / reimbursements | Housing, travel, meals, education or other items. | Cash versus reimbursement and supporting invoices. |
| Taxable income | Amount payroll treats as subject to IIT after applicable exclusions. | Why it differs from gross and whether the treatment has evidence. |
| IIT withheld | Tax withheld and declared by the payer. | Matches the official tax record. |
| Social insurance | Employee share of locally applicable branches/base. | Enrollment, base and any certified agreement exemption. |
| Net pay | Cash after deductions. | Matches the bank deposit and payment date. |
Hypothetical illustration only: if a payslip shows gross salary 40,000, a 2,000 reimbursed item, employee contributions, IIT and a final deposit, those figures cannot be validated from the deposit alone. Request each input and the cumulative tax computation; the example does not state a universal rate or contribution base.
Resident, non-resident and the six-year framework
The Individual Income Tax Law generally treats a person without domicile in China as resident for a tax year if present for 183 days or more; below 183 days the person is non-resident. This changes calculation and filing mechanics, but it does not mean that all work below 183 days is tax-free. China-source services, who pays or bears the salary, treaty provisions and special rules for senior executives can matter.
For a person without domicile who has consecutive 183-day years, the Implementation Regulations and 2019 rules contain a six-year framework for specified foreign-source, foreign-paid income. A single absence of more than 30 days can reset the consecutive-year count under the rule. This is not a DIY “six years tax-free” rule: residence, source, payer and filing/record requirements must all be analyzed.
Keep a daily location and workday log supported by passports, tickets and calendars. Travel days and work performed outside China can matter in a split-payroll analysis.
Withholding and how to verify it
The employer or other payer is generally the withholding agent. For resident salary, the official withholding measures use a cumulative method and monthly filings; non-resident salary uses a different monthly calculation. A resident who must complete annual reconciliation generally does so from March 1 to June 30 of the following year under Article 11 of the IIT Law.
- Register in the official IIT app or Natural Person E-Tax platform using the identity recorded by payroll.
- Compare employer, income period, income and tax with each payslip.
- Ask payroll in writing about duplicates, missing months, wrong passport numbers or unexplained corrections.
- Use the official “tax payment record” function to generate evidence; the State Taxation Administration specifically confirms this route for foreign individuals.
- Before departure or a payroll split, ask whether an annual filing, refund, additional payment or treaty filing is required.
Foreign-employee benefits through 2027
Announcement No. 29 of 2023 extends the qualifying foreign-individual allowance policy through December 31, 2027. A foreign individual who qualifies as a resident may choose either eligible itemized deductions or the specified tax-exempt treatment for benefits such as housing, language training and children’s education, but cannot enjoy both in the same tax year and cannot change the choice within that year.
The word “allowance” in an English offer is not enough. The underlying rules require the particular benefit, reasonable amount and documentary/form requirements. Cash paid without compliant evidence may be taxable. Ask payroll which option was selected, which benefits qualify, what invoices or contracts are required and what will happen after the current policy end date.
Social insurance and bilateral agreements
The Measures on Social Insurance for Foreigners Working in China, revised in December 2024, cover lawfully employed foreign nationals holding the listed work/residence documents and foreign permanent residents. Article 3 requires qualifying local hires—and specified assignees to registered branches or representative offices—to participate in basic pension, medical, work-injury, unemployment and maternity insurance, with employer and employee contributions as provided.
Article 4 requires the employer to register the foreign employee within 30 days after the employment document is handled. Article 9 recognizes bilateral or multilateral agreements. Exemptions are not based on passport alone: they cover only the branches, people and periods in the relevant agreement and generally require a certificate of coverage submitted through the prescribed process. Use MOHRSS’s agreement pages and the local agency, not a crowd-sourced country list.
Evidence to keep and errors to challenge
- ✓ Signed compensation schedule and benefit policy
- ✓ Monthly payslip and bank receipt
- ✓ Bonus/commission calculation and approval
- ✓ Official IIT income and payment record
- ✓ China presence and workday calendar
- ✓ Overseas payroll and recharge information
- ✓ Social-insurance enrollment and contribution statement
- ✓ Certificate of coverage and exemption approval, if used
- ✓ Housing/education/language contracts and compliant invoices
- ✓ Annual filing, refund or payment evidence
Raise a mismatch promptly and factually: “My April payslip shows taxable income X, while the official record shows Y. Please provide the submitted calculation and correction timeline.” Do not accept an unexplained cash refund instead of a corrected official filing.
Hypothetical situations
Hypothetical 1 — 183-day myth: a short-assignment employee assumes 170 days means no China tax. Because the work is performed in China and the local entity bears part of the pay, a treaty/source analysis is still needed.
Hypothetical 2 — housing: an employer adds cash “housing allowance” without invoices and excludes it from taxable income. The employee should ask for the specific policy basis and evidence requirements before assuming the treatment is valid.
Hypothetical 3 — social-security agreement: a Japanese assignee is told that nationality exempts all Chinese contributions. The agreement, covered branches, assignment facts, certificate and approved period must be checked.
