Who this guide is for
Foreign owners, country managers and HR/payroll teams scheduling employees in mainland China. This is a national-law framework. Approval procedures, calculation bases, minimum wages and leave details vary locally and must be checked for the employing location.
Three working-hours systems
| System | Typical legal position | Manager action |
|---|---|---|
| Standard working hours | State Council rules provide 8 hours a day and 40 hours a week; at least one rest day is required. | Use this as the default, publish schedules and record overtime by category. |
| Comprehensive calculation | Hours may be calculated over an approved cycle for qualifying work, subject to applicable rules. | Confirm the role, cycle and current local approval; do not create it by contract wording alone. |
| Flexible working hours | May apply to qualifying roles under local approval practice. | Verify approval scope and local pay/rest treatment; “manager” is not an automatic exemption. |
Store the approval document and covered-position list. If an employee changes role, do not assume the old classification follows. A payroll label such as “overtime included” cannot replace a valid system and transparent calculation.
Limits and the three overtime categories
Labor Law Article 41 says extensions for production and operational needs follow consultation with the trade union and workers and are generally limited to one hour a day. For special reasons, while protecting health, the extension may reach three hours a day but may not exceed 36 hours a month. Article 42 contains narrow exceptions; premium pay is not a license to schedule unlimited overtime.
| When work occurs | National minimum treatment under Article 44 | Can rest replace the premium? |
|---|---|---|
| Beyond normal hours on a workday | At least 150% of wage | Do not assume so; verify the applicable rule. |
| On a rest day | Arrange compensatory rest, or pay at least 200% | Yes, qualifying compensatory rest is the statutory alternative. |
| On a statutory holiday | At least 300% | No statutory substitution with time off. |
The overtime calculation base and what counts as wage can be affected by local rules and valid agreements. Have payroll document its source instead of copying a formula from another city.
Adjusted working days, leave and minimum wage
China’s annual holiday arrangements may move weekends to working days around a holiday. A designated adjusted working day is not automatically rest-day overtime merely because it falls on Saturday or Sunday. Use the official annual calendar and distinguish statutory holidays from swapped rest days.
Employees who have worked continuously for at least 12 months are generally entitled to paid annual leave; statutory days are based on cumulative working time: 5 days after 1 year but under 10, 10 days from 10 to under 20, and 15 days from 20 years. The rules include exclusions, pro-rating and treatment of unused leave. Local and employee-specific facts matter, so maintain evidence of prior service and written leave choices.
Minimum wage is local and changes. Recheck it after each local announcement and before changing schedules, probation pay, deductions or unpaid-status arrangements.
Digital work and proof
WeChat messages, VPN logs, access records, calls, travel schedules and document history can show work outside recorded hours. A pre-approval policy is useful for control but is not magic: if a manager assigns, knows about or accepts the work, a missing form may not end the factual inquiry.
- Set realistic deadlines inside scheduled hours.
- State when messages can wait and use delayed delivery where possible.
- Give employees one accessible approval channel and an exception route for emergencies.
- Reconcile attendance, approvals and payroll each cycle.
- Investigate teams with repeated after-hours traffic instead of blaming individual timekeeping.
A monthly HR compliance routine
- Confirm every role’s actual working-hours system and approval.
- Publish the schedule, rest days and official-holiday treatment.
- Review overtime before it happens; record emergency exceptions afterward.
- Compare time, access, travel and manager-assignment records.
- Classify each hour as workday, rest day or statutory holiday.
- Apply the documented local calculation base and show the result on payroll records.
- Monitor daily and monthly limits, health and recurring capacity problems.
- Retain wage and time records for at least the period required nationally and locally; the national Wage Payment Interim Provisions require written pay records to be kept for more than two years.
Hypothetical situations
Hypothetical 1 — “optional” WeChat: a German manager sends Friday-night tasks due Monday and rewards the fastest weekend response. The operational design contradicts the word optional. Reset deadlines, record necessary work and review past liability.
Hypothetical 2 — annual salary: HR tells a finance manager that annual salary means no overtime. Before relying on that position, verify whether a valid flexible-hours approval covers this person and how local rules treat the work.
Hypothetical 3 — holiday swap: an employee works a Sunday designated as a working day in the official holiday calendar and assumes 200%. Payroll must classify the day using the calendar and actual schedule, not the weekday name alone.
